In das Jahr 2003 fällt wohl auch ein Rechtsstreit zwischen den heutigen Avalons und G. Lowden, der mit einem Vergleich endete. Avalon hatte den Namen Lowden weiter verwendet und daher war es zum Rechtsstreit gekommen. Der Vergleich beinhaltete die Aufgabe der Marke Lowden oder Lowden Guitars durch Avalon. Folgt man dem, was auf der früheren Website von George Lowden stand, müssen der oder die Inhaber von Avalon ziemlich unmittelbar im Anschluß an die vor einem irischen Zivilgericht getroffenen Vergleich in die USA gereist sein, um sich dort den Namen Lowden Guitars als Firma eintragen zu lassen. Klingt ziemlich schofelig und ich habe G. Lowden daher seinen Erfolg gegönnt. Inzwischen ist derlei aber nicht mehr zu lesen und einer sicheren Quelle zufolge will Geroge Lowden sich über dieses Thema auch nicht mehr verbreiten. Das Kapitel sei abgeschlossen.

After many failed attempts to
establish alternative dispute resolution processes over a period of some 11 months, George served a high court writ for what he believed were serious breaches of contract. The company denied all charges, and after more
than 18 months of legal action including a counterclaim by the company and additional claims by George, the matter was finally settled by agreement at the court door. The aim of this agreement was to allow a way forward for both parties by limiting further damage and providing a basis for separation.
Following 18 months of formal legal action, George Lowden succeeded in
terminating the licensing agreement with the Lowden Guitar Company as part of a ‘court door’ settlement. All rights to the Lowden designs and trademark revert solely to George Lowden from 1st January 2004. This agreement ends a 4 -year relationship with the newest directors of the Lowden Guitar Company but allows a transition period where the company can continue making Lowden guitars until the end of 2003. This period also allows George time to plan the new phase of the Lowden business. As a part of this agreement, George agrees to pay a small levy for each Lowden guitar produced in excess of 2000 for the first three-year period. On the 25 th February 2003, Steve McIlwrath signed the agreement on behalf of the Lowden Guitar Company which includes a stipulation that the company (defendant) would "on or before 1st January 2004 change it’s name so that the word ‘Lowden’ does not appear as any part of its name” and cease to use the word ‘Lowden’ “in connection with the manufacture, sale and/or promotion of guitars.”
Also ging es damals richtig zur Sache, Klage, Widerklage und noch ein paar weitere Klagen. Bei sowas würde ich gerne mitmachen. Da wären Beruf und Hobby auf die schönste Weise vereint.
